Terms of Use

These Terms of Use constitute the legal framework for using the Education Visions website (https://visions.analytrics.org, hereinafter referred to as “the Website”). They define the conditions for access and use of services by users (hereinafter referred to as “the User”).

Any use of the Website implies the User’s acceptance of these Terms of Use, without any reservation or restriction. By submitting podcast content or utilising the podcast functionalities, the User implicitly accepts these Terms of Use.

In case of non-acceptance of these Terms of Use, the User must renounce the services offered by the Website.

Analytrics reserves the right to unilaterally modify the content of these Terms of Use at any time.

ARTICLE 1: Access to the Website

The Website allows the User free access to the following services: submission of podcast content; and opening, downloading, link copying, and sharing the podcast episodes posted on the Website.

The Website is accessible free of charge anywhere to any User with Internet access. All the costs borne by the Users to access the service (computer hardware, software, Internet connection, etc.) are at their expense.

To have access to the content submission service, the User must provide personal data. The User commits to providing sincere and accurate data.

Users’ personal data (name, profession, and affiliation/organisation) are mentioned in the presentation and voice content of the audio files, and cannot be changed once the audio file is published.

Under no circumstances will the User hold Analytrics or the Education Visions Team responsible for malfunctions of the Website or interruptions or suspensions of the service, even without notice, whatever the causes of these malfunctions, interruptions, or suspensions, including situations of force majeure or maintenance operations.

ARTICLE 2: Data collection

Analytrics collects and processes personal information through the Website with respect for privacy in accordance with the French Law No. 78-17 of 6 January 1978 (“Loi relative à l’informatique, aux fichiers et aux libertés”).

Under this law, the User has the right to access, rectify, delete, and object to the use of his/her personal data. The User exercises this right by email sent to the editor at editor@analytrics.org. However, the name, profession, and affiliation/organisation provided by a User when submitting podcast content are part of the presentation and voice content of the audio file and may not be changed after the publication of the file.

ARTICLE 3: Intellectual property

Analytrics owns the intellectual property rights in all of the content of this website, including the audio files.

The brands, logos, signs as well as all the contents of the Website (audio files, texts, images, etc.) are subject to protection by the French Intellectual Property Code and more particularly by copyright.

The User must seek the prior permission of Analytrics for any reproduction, publication, or copy of the contents of the Website. Any use of the Website for commercial purposes is strictly prohibited.

Any total or partial representation of the Website by any means whatsoever without the express permission of the administrator constitutes an infringement punishable by Article L 335-2 and followings of the French Intellectual Property Code.

Within this framework, use of the Website for any lawful purpose is permitted provided that Analytrics’s copyrights are complied with and the Website is appropriately credited. No permission is required for opening, downloading, link copying, and sharing the podcast episodes posted on the Website.

ARTICLE 4: Liability

The sources of the information published on the Website are deemed reliable, but Analytrics does not guarantee that its content is free from defects, errors, or omissions.

The information communicated is presented for indicative and general purposes without contractual value. Analytrics cannot be held accountable for the use and interpretation of the information provided on the Website.

Analytrics cannot be held responsible for any viruses which could infect the computer or any computer equipment of the Internet user, following use, access, or download from the Website.

Analytrics cannot be held liable in the event of force majeure or for the unforeseeable and insurmountable fact of a third party.

ARTICLE 5: Hypertext links

Hypertext links may be present on the Website. Clicking some of these links may lead to leaving the Website. Analytrics has no control over the web pages to which these links lead and can in no way be held responsible for their content.

ARTICLE 6: Cookies

While visiting the Website, cookies may be automatically installed (see our Cookie Policy).

Cookies are temporarily stored on the hard drive of the User’s computer and are necessary for the use of the Website. Cookies do not contain personal information and cannot be used to identify anyone. A cookie contains a unique identifier, generated randomly and therefore anonymous. Some cookies expire at the end of the User’s visit, others don’t.

The information contained in cookies is used to improve the Website. By browsing the Website, the User accepts these cookies.

The User must, however, consent to the use of certain cookies. In the absence of acceptance, the User is informed that access to certain features or pages may be denied.

ARTICLE 7: User’s role and intellectual property

The Website allows users to submit content for consideration for the production of podcast episodes. If the submitted content is accepted for inclusion in the podcast, the Education Visions team produces the podcast episode, using all or part of the content submitted by the User. By submitting content, the User gives Analytrics the right to edit the submitted content as Analytrics deems it appropriate for the purpose of setting up the audio file.

The name, occupation, and affiliation/organisation of the User whose content is used must be duly mentioned in the audio file presentation and voice content. The Users retain their full intellectual property rights over the work that they reported on in the content that they submitted.

ARTICLE 8: Applicable law and competent jurisdiction

French law applies to these Terms of Use. In case of a dispute and in the absence of an amicable resolution, the French courts will have sole jurisdiction to hear it.
